Terms and conditions

1. Introductory Provisions and Definitions

  1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the mutual rights and obligations between Wrap Rental s.r.o., Company ID No.: 19617267, with its registered office at Kupkova 947/17, 103 00 Prague 10 – Kolovraty, registered with the Municipal Court in Prague, Section C, Insert 405556 (hereinafter referred to as the “Lessor”), and its customers (hereinafter referred to as the “Lessee”) in connection with rental agreements for movable items (in particular photographic and film equipment; hereinafter referred to as the “Leased Item”).

  3. The Lessee is any natural or legal person who enters into a rental agreement with the Lessor. A distinction is made between a consumer (a natural person acting outside the scope of their business activity) and an entrepreneur (a person acting within the scope of their business activity).
  4. By entering into the rental agreement, the Lessee confirms that they have read and agree to these GTC. The GTC form an integral part of every rental agreement.

2. User Account and Registration

  1. A booking may be made via the Lessor’s website interface with registration (user account, hereinafter referred to as the “Account”) or without registration.
  2. The Lessee is obliged to provide true and accurate information during registration and to update such information without delay in the event of any change.
  3. The Account is protected by a password, which the Lessee is obliged to keep confidential. The Lessor is not liable for any misuse of the Account by a third party resulting from insufficient protection of login credentials by the Lessee.
  4. The Lessor may cancel the Account if the Lessee does not use it for more than 1 year or breaches obligations under the GTC or the rental agreement.
  5. The Lessee acknowledges that the website interface may be temporarily unavailable due to maintenance or unexpected malfunction.

3. Establishment and Changes of the Rental Relationship

  1. The rental agreement is concluded for a fixed term according to the period selected by the Lessee. It is established: (a) by confirmation of a booking made via the website interface, or (b) in person at the business premises by signing the agreement.
  2. The presentation of the Leased Item on the website is for information purposes only and does not constitute a binding offer; the Lessor is not obliged to accept every booking.
  3. Identity verification. For the purpose of fraud prevention, the Lessor may request verification of the Lessee’s identity (or the identity of a person acting on the Lessee’s behalf) online through third-party tools or physically upon handover by inspecting an identity document. No copies of documents are made without the Lessee’s consent. Refusal to provide cooperation is grounds for not handing over the Leased Item and for withdrawal from the agreement.
  4. No later than 24 hours before the agreed handover time, the Lessee may request a change to the booking (e.g. change of date, change of items). The Lessor will accommodate the request if the change is operationally possible.
  5. Cancellation. If the Lessee cancels the booking less than 24 hours before handover, the Lessee shall pay a cancellation fee equal to one day’s rental fee. The same applies if the Lessee fails to take over the Leased Item at the agreed time for reasons attributable to the Lessee.
  6. Guarantor of the booking. If the booking is arranged by a person other than the payer, this guaranteeing person guarantees payment of all amounts and claims arising from the given booking if the payer fails to fulfil their obligations on time.

4. Rental Fee, Security Deposit and Payment Terms

  1. The amount of the rental fee is governed by the price list published on the website or is agreed individually. Unless agreed otherwise, the Lessor is entitled to the rental fee for each commenced day of rental.
  2. The Lessor may require the payment of a monetary security deposit. If the Lessee fails to pay the deposit, the Lessor may withdraw from the agreement.
  3. The deposit serves to secure the Lessee’s obligations; if no amount is deducted from it, the Lessor shall return it within 10 days after the end of the rental and settlement of any claims, or set it off against such claims.
  4. Payment methods: bank transfer, payment card (online or in person), or cash if permitted by the Lessor.
  5. For new customers, the Lessor may require payment of the rental fee upon handover, ideally by payment card in the name of the Lessee or an authorised person.

5. Obligations and Liability of the Lessor

  1. The Lessor shall hand over the Leased Item at the agreed time and place in a condition suitable for normal use.
  2. If agreed, the Lessor shall familiarise the Lessee with the basic operation of the Leased Item and provide the necessary information.
  3. The Lessor is not liable for damage caused by improper handling or as a result of failure to follow the operating instructions.
  4. The Lessor has the right to proper payment of the rental fee and agreed charges; in the event of default, the Lessor may use the deposit and/or withdraw from the agreement.
  5. Handover and return protocol. Upon handover, the parties shall complete a handover protocol (condition, accessories, serial numbers, batteries, media). Upon return, they shall complete a return protocol. The Lessee is obliged to report any obvious defects or missing items upon handover.

6. Obligations of the Lessee and Liability for Damage

  1. The Lessee shall take over the Leased Item at the agreed time and use it for the agreed or usual purpose with due care.
  2. Without the Lessor’s prior written consent, the Lessee shall not provide the Leased Item to any third party, including for further rental, and shall not take it outside the territory of the Czech Republic.
  3. The Lessee shall not make any modifications or repairs without the Lessor’s express consent; in the event of breach, the Lessee shall be liable for damage and any loss of warranty/manufacturer claim eligibility.
  4. Data stored by the Lessee on rented media is managed by the Lessee at their own risk; the Lessor is not liable for its loss.
  5. After the end of the rental, the Lessee shall return the Leased Item at the agreed time and place in a condition corresponding to normal wear and tear.
  6. The Lessee is liable for damage to the Leased Item from the moment of handover until return. In the event of damage, loss or destruction, the Lessee shall pay the actual costs of repair or replacement and, in addition, reasonable lost profit corresponding to demonstrably lost rentals in the subsequent period.
  7. Cooperation in the event of damage. The Lessee is obliged to take photographic documentation without undue delay and provide cooperation in accordance with Article 11.

7. Termination of the Rental

  1. The rental ends upon expiry of the agreed period, by agreement of the parties, by withdrawal from the agreement, or by termination if permitted by law or agreement.
  2. The Lessor may withdraw from the agreement in the event of a serious breach of the Lessee’s obligations, such as repeated non-payment of the rental fee, unauthorised export outside the Czech Republic, refusal to verify identity, etc.
  3. If the Lessee fails to return the Leased Item on time, the Lessee is obliged to (a) pay the rental fee for each additional commenced day of delay and (b) pay a contractual penalty of 15% of the daily rental fee for each commenced day of delay. Payment of the contractual penalty does not affect the Lessor’s right to compensation for damage in full.

8. Consumer Information — Withdrawal from the Agreement

  1. If the Lessee is a consumer and the agreement was concluded remotely or outside the Lessor’s usual business premises, the Lessee may withdraw from it without giving any reason within 14 days from the date of conclusion.
  2. To withdraw, it is sufficient to send a clear statement by e-mail to info@wraprental.cz (use of a form is not required). Please state at least your first and last name, booking/agreement number, date of conclusion and the statement “I withdraw from the agreement”.
  3. After withdrawal, the consumer is obliged to return the Leased Item without undue delay, no later than within 14 days, to the address: Kupkova 947/17, 103 00 Prague 10 – Kolovraty.
  4. If the rental was commenced at the consumer’s express request before the expiry of the withdrawal period, the consumer shall pay a proportionate part of the rental fee for the period until withdrawal. If the service was fully completed during the withdrawal period at the consumer’s express request, the right of withdrawal expires.
  5. We will refund payments within 14 days of receipt of the withdrawal notice, but not before the Leased Item has been returned or proof of its dispatch has been provided. Funds will be refunded using the same payment method unless agreed otherwise.

9. Personal Data Protection

  1. The processing of personal data is governed by the document Privacy Policy.
  2. The Lessor processes personal data primarily because it is necessary for the performance of the agreement (Article 6(1)(b) GDPR), to the necessary extent. The Lessee has the right of access, rectification, erasure, restriction of processing, objection, and the right to lodge a complaint with the supervisory authority, the Czech Office for Personal Data Protection.

10. Sending of Notices and Communication

  1. The Lessee agrees to the use of e-mail/phone/SMS for the conclusion and performance of the agreement. Commercial communications may be sent only on the basis of the Lessee’s consent; without consent, only similar products/services may be offered to existing customers pursuant to Section 7(3) of Act No. 480/2004 Coll., always with an easy option to unsubscribe.
  2. The Lessee may express disagreement with receiving such communications at any time in the manner specified in each message, such as via an unsubscribe link.

11. Insurance of Rented Equipment

  1. The insurance terms for rented equipment and the procedure in the event of damage are set out on the Insurance page.

12. Equipment Delivery to the Filming Location

  1. The Lessor offers equipment delivery within Prague and the surrounding area up to 50 km. The service can be ordered during booking, by phone or in person.
  2. Price: fixed fee of CZK 300 per trip + CZK 10/km, calculated both ways. The price will be communicated upon confirmation of the booking.
  3. Availability daily from 08:00 to 20:00. Minimum order lead time is 24 hours. The exact delivery time is agreed individually.
  4. The Lessee is obliged to be present at the agreed time and place and take over the equipment; in the event of absence, repeat delivery may be charged. Upon handover, the Lessee shall carry out a visual inspection and immediately report any discrepancies.
  5. The Lessor is responsible for safe transport until the moment of handover. The Lessor is not liable for delays caused by force majeure or extraordinary circumstances.

13. Final Provisions

  1. Legal relations are governed by the laws of the Czech Republic. Consumer disputes may be resolved through the Czech Trade Inspection Authority (www.coi.cz) and online through the European Commission’s ODR platform (https://consumer-redress.ec.europa.eu).
  2. If an international element is present, the parties choose Czech law; this does not affect the mandatory consumer rights in the country of the consumer’s habitual residence.
  3. The invalidity or ineffectiveness of any individual provision does not affect the validity of the remaining GTC; the affected provision shall be replaced by wording that most closely corresponds to the original intent.
  4. The Lessor is entitled to amend the GTC to a reasonable extent; this does not affect the rights and obligations arising during the effective period of the previous version. We archive the wording of the GTC in a form enabling remote access. The contractual language is Czech.
  5. These GTC become effective on 1 September 2025.
